The client downloads executable code to run work units. Apple will not approve such apps. If the cores appear as DLC in the app store, I don't see why they wouldn't approve it. I have run a quite few other cards and have never noticed this behavior before. Usually a card with no power limit runs at 100% of power while folding. What exactly is FaH using all this PCIe bandwidth for? CPU usage when GPU folding is absolutely negligible, at least on AMD platform - one or two percent of one CPU thread is what I'm typically seeing.
